AN ACT to amend chapter seventy-eight of the laws of nineteen hundred eighty-one, relating to Authorizing the towns of Rushford and Caneadea in Allegany county to establish the Rushford Lake Recreation District, in relation to authorizing the town boards of the towns of Rushford and Caneadea to extend the boundaries of the Rushford Lake Recreation District.

The People of the State of New York, represented In Senate and Assem­bly, do enact as follows:

Section 1. Section nineteen of chapter seventy-eight of the laws of nineteen hundred eighty-one, relating to authorizing the towns of Rush­ford and Caneadea in Allegany county to establish the Rushford Lake Re­creation District, is renumbered section twenty and a new section nineteen is added to read as follows:
§ 19. (a) The town boards of the towns of Rushford and Caneadea In Al­legany county are hereby authorized to extend the boundaries of the Rushford Lake Recreation District in accordance with the Provisions of article twelve or twelve-A of the town la-w.1 except as otherwise provided in subdivision (b) of this section,   subject to the provisions of arti­cle twelve or twelve-A of the town law, the town boards are authorized to extend the boundaries of said district beyond those described in sec­tion three of this chapter.

(b) Any petitions for the extension of such district shall be submit­ted to the town boards of the towns of Rushford and Caneadea and all pu­blic hearings required to be held shall be conducted jointly by the town boards of said towns. After any such hearing, each town board shall determine by resolution those findings required by section one hundred ninety-four or section two hundred nine-e of the town law. If and when each town board adopts a resolution approving the extension of the Rush­ford Lake Improvement District, and after a referendum, if required, by section two hundred nine-e of the town law, the town boards of the towns of Rushford and Caneadea shall be authorized to jointly adopt an order extending the Rushford Lake        Recreation District, which order shall, within ten days following the adoption of the order, be filed with the town clerks of the towns of Rushford end Caneadea., the Allegany county clerk and the office of the state department of audit and control in Albany, New York.
